MoonLit Tours LLC Terms & Conditions Effective Date: 08/01/2026

1. Booking & Payments All reservations require the applicable deposit to hold a seat. A reservation is not secured until the required deposit has been received and accepted by MoonLit Tours LLC. The remaining balance is due 45 days prior to the scheduled trip date, unless a different deadline is specifically stated for that trip. Passengers may pay the balance in full at any time or make multiple payments, provided the entire balance is paid by the applicable due date. MoonLit Tours LLC may establish different deposit amounts, payment schedules, or final-payment deadlines for individual trips. The terms published for the specific trip will apply when they differ from these general terms. Late Payments If the remaining balance is not paid by the stated deadline, MoonLit Tours LLC reserves the right to cancel the reservation and make the seat available to another passenger. Any payments already made will be handled according to the applicable cancellation and credit policy, except where otherwise required by law.

2. Refunds, Credits & Cancellations Unless specifically stated otherwise for a particular trip, payments are non-refundable. If a passenger cancels or is unable to attend, MoonLit Tours LLC may issue future travel credit according to the applicable trip policy. Credits: • Have no cash value. • Are not redeemable for cash. • Are generally non-transferable unless MoonLit Tours LLC specifically approves a transfer. • May be subject to an expiration date or other conditions stated when issued. MoonLit Tours LLC is not required to provide a refund or credit outside the applicable posted cancellation policy except where required by law.

3. Trip Cancellation / Go-No-Go Policy MoonLit Tours LLC reserves the right to establish a minimum number of passengers required for a trip to operate. If the minimum number is not reached, MoonLit Tours LLC may cancel, reschedule, or modify the trip. If MoonLit Tours LLC cancels a trip because the minimum passenger requirement is not met, payments will be handled according to the cancellation policy announced for that trip and applicable law. MoonLit Tours LLC will make reasonable efforts to notify affected passengers of a cancellation or significant change.

4. Transportation MoonLit Tours LLC does not own or operate the charter buses used for its trips. Transportation is provided by independent, licensed and insured third-party transportation companies. MoonLit Tours LLC coordinates the trip and passenger experience but does not control the operation of the vehicle, driving decisions, driver employment, mechanical maintenance, or other transportation-company operations. Passengers must follow all reasonable instructions from the charter company’s driver and MoonLit Tours staff.

5. Seat Assignment Policy Seats may be assigned by MoonLit Tours LLC before departure to promote safety, organization, and efficient boarding. Passengers may request preferred seats when booking; however, seating requests are not guaranteed. Requests to sit with family or friends will be accommodated when reasonably possible but cannot be guaranteed. MoonLit Tours LLC reserves the right to assign or change seating when reasonably necessary for safety, accessibility, passenger needs, operational reasons, or other legitimate circumstances. Passengers must remain seated while the bus is moving except when permitted by the driver or when using the restroom.

6. Passenger Requirements & Conduct Passengers must be reasonably fit and prepared for the physical demands of the specific trip, including potentially extended periods of sitting, walking, standing, waiting, stairs, uneven surfaces, or other activities depending upon the destination. Passengers are responsible for determining whether a trip is appropriate for their individual physical abilities and needs. Alcohol is not permitted on MoonLit Tours LLC trips, unless MoonLit Tours LLC specifically states otherwise for a particular trip. Illegal drugs and other unlawful substances are prohibited. Threatening, violent, abusive, discriminatory, disruptive, unsafe, or inappropriate behavior will not be tolerated. MoonLit Tours LLC reserves the right to refuse participation or remove a passenger whose conduct creates a safety concern, significantly disrupts the trip, violates these Terms & Conditions, or interferes with the enjoyment or safety of other passengers. No refund or credit will be provided for removal resulting from a passenger’s misconduct, except where required by law.

7. Removal From a Trip If a passenger is removed from a trip because of unsafe, threatening, disruptive, unlawful, or otherwise unacceptable conduct, MoonLit Tours LLC may require the passenger to leave the tour at the earliest reasonably safe location. Unless required by law or caused by MoonLit Tours LLC’s own obligations, the passenger may be responsible for all costs associated with arranging their own transportation, lodging, meals, or other expenses after removal.

8. Children & Safety Seats Children ages 3 and up are welcome unless a particular trip states otherwise. Parents and legal guardians are solely responsible for supervising children throughout the trip. If a child requires a safety seat, the parent or guardian is responsible for providing and properly securing an appropriate seat and complying with applicable safety requirements. MoonLit Tours LLC does not provide child safety seats unless specifically stated for a particular trip.

9. Overnight / Red-Eye Travel Many MoonLit Tours trips involve overnight travel. Passengers should be prepared to sleep or rest on the bus during portions of the trip. Lights may be dimmed and reasonable quiet periods may be observed for passenger comfort. Standing or moving through the aisle while the bus is moving is prohibited except when necessary to use the restroom and when it is safe to do so. Passengers must follow the driver’s safety instructions at all times.

10. Pickup, Departure & Missed Departure Passengers are responsible for knowing their assigned pickup location and boarding time. Passengers should arrive sufficiently early to board before the scheduled departure. The bus may depart at the scheduled time and will not necessarily wait for late passengers. A passenger who misses the bus or fails to arrive at the required time may be responsible for arranging and paying for their own transportation and other expenses. MoonLit Tours LLC is not responsible for costs resulting from a passenger’s failure to arrive on time.

11. Itineraries & Schedule Changes Trip schedules, routes, pickup locations, departure times, rest stops, attractions, activities, and itineraries may change. Changes may result from traffic, weather, road conditions, mechanical problems, driver regulations, attraction or venue changes, emergencies, government actions, closures, or other circumstances beyond MoonLit Tours LLC’s reasonable control. MoonLit Tours LLC will make reasonable efforts to provide passengers with significant itinerary changes when practical. Published itineraries are subject to change and are not guaranteed.

12. Weather & Unforeseen Circumstances MoonLit Tours LLC may alter, delay, reschedule, or cancel portions of a trip because of circumstances beyond its reasonable control, including severe weather, natural disasters, road closures, accidents, traffic, government restrictions, public emergencies, venue closures, mechanical problems, transportation disruptions, or other unforeseen events. MoonLit Tours LLC will make reasonable efforts to protect passenger safety and communicate significant changes. Any refunds or credits resulting from such circumstances will be handled according to the applicable trip policy and applicable law.

13. Third-Party Providers MoonLit Tours LLC may use independent third-party companies and providers, including charter bus companies, hotels, restaurants, attractions, venues, transportation providers, and other vendors. MoonLit Tours LLC is not responsible for the independent acts, omissions, policies, closures, cancellations, service interruptions, injuries, damages, delays, or failures of third-party providers except to the extent responsibility cannot legally be excluded. MoonLit Tours LLC may assist passengers in communicating with a third-party provider when appropriate but does not guarantee a particular outcome.

14. Personal Belongings Passengers are responsible for their own personal belongings. MoonLit Tours LLC is not responsible for lost, stolen, misplaced, or damaged personal property except where liability is required by law. Passengers should not leave valuable items unattended on the bus or at destinations. If an item is found and turned in, MoonLit Tours LLC may make reasonable efforts to return it. Any shipping or delivery costs may be the passenger’s responsibility.

15. Parking Disclaimer & Vehicle Liability MoonLit Tours LLC and the parking destination are not responsible for any damages, theft, or loss to vehicles or their contents left on the parking lot premises. Vehicles are left at the owner’s own risk. By parking at the designated parking destination, you acknowledge and agree that MoonLit Tours LLC and the parking destination are not liable for any damage, theft, or loss involving your vehicle, to the fullest extent permitted by applicable law.

16. Luggage & Personal Items Passengers are responsible for keeping track of their luggage and personal belongings. MoonLit Tours LLC may establish luggage size, weight, and quantity limits for individual trips based on the charter company’s requirements and available storage space. Passengers should label their luggage with their name and contact information. MoonLit Tours LLC is not responsible for lost, stolen, misplaced, or damaged luggage except where liability is required by law. Passengers may be required to keep medications, identification, money, valuables, and other essential items with them rather than placing them in stored luggage.

17. Smoking, Vaping & Tobacco Smoking, vaping, and the use of tobacco or nicotine products are prohibited on MoonLit Tours LLC charter buses and in any areas where prohibited by law or by the transportation company. Passengers must follow all smoking and vaping rules established by the charter company, hotels, attractions, and other third-party providers. Any passenger who violates this policy may be subject to removal from the trip and may be responsible for cleaning, damage, or other costs caused by their violation, to the extent permitted by law.

18. Hotel Room Policy When lodging is included in a trip, room assignments are made according to the arrangements available for that trip. Roommate and bed-type requests are not guaranteed. Passengers are responsible for following all hotel rules and for any damage, missing items, smoking charges, cleaning fees, or other charges caused by them or members of their party, to the extent permitted by law. Passengers are responsible for meeting hotel check-in and check-out times. MoonLit Tours LLC is not responsible for expenses resulting from a passenger’s failure to check in on time or comply with hotel policies.

19. Payment Transfers & Booking Changes Reservations, deposits, payments, and travel credits may not be transferred to another person or another trip unless MoonLit Tours LLC approves the change in writing. Requests to change a passenger name, trip date, pickup location, roommate, or other booking information are subject to availability, applicable deadlines, and any fees or restrictions announced for the specific trip. MoonLit Tours LLC is not required to approve booking changes that would interfere with transportation, hotel, attraction, ticketing, or other third-party arrangements.

20. Payment Processing & Returned Payments Passengers are responsible for using an accepted payment method and providing accurate payment information. A returned, declined, reversed, or disputed payment may result in the reservation being placed on hold or canceled until the issue is resolved. Any payment-processing, returned-payment, or administrative fees will be disclosed when applicable and may be charged to the passenger to the extent permitted by law. Payment-processing fees, booking fees, or other stated fees are non-refundable unless otherwise required by law or specifically stated for the trip.

21. Accessibility & Special Needs Passengers with mobility, accessibility, dietary, medical, or other special requirements should notify MoonLit Tours LLC before booking whenever possible. MoonLit Tours LLC will make reasonable efforts to communicate known accessibility information and accommodate reasonable requests when possible. However, MoonLit Tours LLC cannot guarantee that every destination, attraction, venue, hotel, sidewalk, restroom, or other location will be fully accessible. Passengers are responsible for determining whether the physical requirements of a particular trip are appropriate for their individual needs.

22. Medical & Emergency Situations Passengers are responsible for providing accurate emergency-contact information when requested. In the event of an emergency, MoonLit Tours LLC and/or its representatives may contact emergency services or appropriate medical personnel when reasonably necessary. MoonLit Tours LLC is not responsible for medical expenses, treatment decisions, medical transportation, or other medical costs incurred by a passenger except where otherwise required by law. Passengers should carry any medications, medical equipment, identification, insurance information, and other necessities they may require during travel.

23. Assumption of Risk Travel involves inherent risks, including but not limited to transportation, road conditions, weather, walking, stairs, crowds, public locations, attractions, recreational activities, and other ordinary travel-related risks. By participating in a MoonLit Tours trip, passengers acknowledge these inherent risks and voluntarily choose to participate. Nothing in these Terms & Conditions is intended to waive or limit any liability that cannot legally be waived or limited under applicable law.

24. Limitation of Liability To the fullest extent permitted by applicable law, MoonLit Tours LLC, its owners, employees, agents, and representatives shall not be responsible for losses, expenses, delays, injuries, damages, or other claims arising from circumstances outside MoonLit Tours LLC’s reasonable control or from the independent acts or omissions of third-party providers. Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.

25. Passenger Responsibility Passengers agree to follow: • These Terms & Conditions. • Reasonable instructions from MoonLit Tours LLC staff. • Safety instructions from the charter company’s driver. • Applicable laws and regulations. • Rules established by attractions, hotels, venues, and other third-party providers. Passengers may be responsible for damage they intentionally or negligently cause to MoonLit Tours LLC property or property belonging to a third-party provider, to the extent permitted by law.

26. Photo & Video MoonLit Tours LLC may photograph or record group activities, trips, events, or passengers for promotional, social-media, website, or other business purposes. Where a specific release or consent is required by law, MoonLit Tours LLC will obtain the appropriate consent. Passengers who do not wish to be included in promotional photographs or videos should notify MoonLit Tours LLC in advance.

27. Privacy & Passenger Information MoonLit Tours LLC may collect passenger information necessary to process bookings, communicate trip information, coordinate transportation, respond to emergencies, and administer the trip. Passenger information will be handled according to MoonLit Tours LLC’s applicable privacy practices and applicable law. Passengers are responsible for providing accurate contact and passenger information.

28. Loyalty Program Loyalty rewards are earned according to the rules published for the MoonLit Tours LLC loyalty program. Rewards have no cash value and are generally non-transferable. MoonLit Tours LLC reserves the right to modify, suspend, or discontinue the loyalty program at any time, subject to applicable law.

29. Chargebacks & Payment Disputes Passengers agree to first contact MoonLit Tours LLC regarding questions or disputes concerning payments, cancellations, credits, or reservations. Initiating a payment dispute or chargeback does not automatically cancel or override these Terms & Conditions. MoonLit Tours LLC may provide the applicable booking records, payment records, communications, and Terms & Conditions to the payment processor or financial institution when responding to a payment dispute. Nothing in this section prevents a passenger from exercising rights provided by applicable law.

30. Changes to These Terms MoonLit Tours LLC reserves the right to update or modify these Terms & Conditions when reasonably necessary. The Terms & Conditions applicable to a passenger’s booking will be those presented and accepted at the time of booking, subject to legally required changes or provisions that expressly apply to future bookings.

31. Severability If any provision of these Terms & Conditions is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

32. Governing Law These Terms & Conditions shall be interpreted under applicable Kentucky law, except to the extent another law is required to apply. Nothing in these Terms & Conditions is intended to deprive a passenger of rights that cannot legally be waived.

33. Entire Agreement These Terms & Conditions, together with the specific trip information, booking information, payment terms, policies, and any written agreements applicable to a particular trip, constitute the agreement between the passenger and MoonLit Tours LLC concerning that booking. If a specific trip’s published terms conflict with these general Terms & Conditions, the specific trip terms will control for that trip.

34. Acknowledgment & Acceptance By booking a trip, submitting a passenger form, making a payment, or traveling with MoonLit Tours LLC, the passenger acknowledges that they have had an opportunity to review these Terms & Conditions and agree to comply with them. For minors, the parent or legal guardian making the reservation is responsible for accepting these Terms & Conditions on the minor’s behalf.
